General

These terms and conditions accompany and form part of every meeting, quotation written or verbally given for works to be carried out by perth garden lights, unless expressly agreed in writing, acceptance of our quotation means that you accept these terms and conditions in their entirety.
Payment terms are strictly 7 days from date of invoice and we understand and will exercise our statutory right to claim interest and compensation for debt recovery costs under the late payment legislation if we are not paid according to agreed credit terms.
perth garden lights sometimes uses images or customers names to promote business on the Internet or other mediums. If you object to this then please let us know.
The quotation is valid for 30 days from the date of the quotation.
These terms and conditions will continue to apply to any work done for a customer unless specifically amended in writing.
If access through or from a neighboring property is required to carry out specific tasks, permission must be sought from the property owner or tenant before commencement of work.
Loud machinery is sometimes used to carry out work. Please inform us in advance if there is a time when this will cause you problems. These machines can also create dust and smoke. Please keep your windows shut while maintenance work is been carried out.
Sometime our team will be using controlled chemicals to kill weeds or promote growth. These are generally considered non-toxic but should you be concerned or request more information then speak to your project manager so he can provide you with details.
The quotation only covers the specific works as noted on the quotation. Additional work requested outside the scope of the original quotation will be subject to additional charges.
As far as is possible, all work is carried out at times agreed with the customer but, due to the nature of our scheduling, specific times cannot be guaranteed.
It is the responsibility of the customer to inform perth garden lights 48hrs in advance if work to be carried out on a specific day is to be cancelled. perth garden lights reserves the right to charge the customer where we are unable to start work at an appointed time.
Payment methods are cash, cheque and Internet bank transfer.
perth garden lights will not take responsibility for any damage to (or cost involved with) any underground hazards, obstructions or services not made known to us in writing or apparent on visual inspection. This must be advised or visually brought to any staff on site/s attention on first visit or in duration of visit.
The removal of dog excrement or large amounts of litter from the site is the responsibility of the client. perth garden lights reserves the right to charge extras for pets excrement removal.

Garden lights

perth garden lights is committed to providing the best possible garden construction experience for our customers, however not every eventuality can be foreseen. We recommend that you read and understand all the points in the terms and conditions.
Please bear in mind that during construction your garden is classed as a building site. Our staff are trained to make them as safe as reasonably possible. We recommend that children and pets are not permitted to enter the site until work is complete, and all persons entering the confines of the working area are either competent or supervised.
Vandalism, acts of God or outside negligence – during the construction perth garden lights will take reasonable steps to protect the work, however cannot be held responsible for acts of wanton vandalism or unexpected occurrences such as extreme weather conditions or any other event that one could not reasonably predict.
Any changes to the agreed work need to be discussed and a new price agreed before commencement of extra or changed specifications.
A non-refundable booking deposit is expected to secure a scheduling date* that will be deducted from your final invoice. All material costs will need to be paid in advance on the outset of the work. An interim payment during construction of 50% of remaining balance at an approximate halfway point if the work is planned for more than five days. Final invoice is to be settled on satisfactory completion of work. A charge of 1% per day may be applied to any outstanding sums after 7 days from the satisfactory completion of work unless agreed otherwise.
Weed suppressing geo-textiles are not 100% effective. A good quality textile will have a significant impact on weed growth in a treated area but will not completely stop their spread.
Surplus materials remain the property of Perth Landscaping unless the customer has made a direct payment to the supplier for them.
We strongly recommend that you do not make unchangeable plans in the week(s) immediately following the expected completion times that will affect the construction should we be delayed.
A strike to an underground service is always a possibility whenever excavation of any kind is carried out. In a high risk situation every care is taken to preserve any gas, water, electricity or telephone cables however perth garden lights cannot be held liable for expenses incurred by the utility companies in such an event unless we are provided with accurate service locations (clients are required to provide us with service location by contacting DIAL BEFORE YOU DIG).
No spoils, rubbish or waste will be removed from site for disposal unless specified in the quote. In the event of toxic waste been uncovered during excavation, perth garden lights will not be held liable for the costs of the professional removal of the materials. perth garden lights will assist in the removal of materials if possible however any unexpected costs will be added to the final invoice.
The quoted price is to carry out the work described. Sometimes jobs take longer than expected and sometimes they take less time than expected. This is what is known as “win some, lose some”. As long as changes to the specifications have not been made after construction has begun, no compensation for early finishing will be made just as no extra expense will be incurred if the work takes longer.
No allowance has been made in the quotation for any unforeseen scenarios such as concrete sub bases or drainage systems. Extra excavation and disposal costs may be added to the final invoice.

* A secure schedule date refers only to your place in the queue, not a promise to start on the predicted date. If the start and / or completion date is imperative this must be made clear during negotiations.

Garden Maintenance

The term waste removal refers only to waste produced by perth garden lights. Additional green waste should be discussed with perth garden lights prior to commenced visit. Hard rubbish removal will incur an extra fee.
Our operatives and management team are trained to assess and plan the work to provide long-term effectiveness and a quality job. Sometimes gardens that have been neglected will require a number of visits to bring them to a high standard of care.
Automatic watering outlets such as pop up sprinklers or sprayer are sometimes not visible due to overgrown lawn or garden bed, they sometimes stay stuck in up position due to poor maintenance. perth garden lights will not take any responsibility of any damage made to reticulation unless the position of the outlets are made clear to the operator prior commencing the job.
